END USER LICENSE AGREEMENT (EULA)

1. AGREEMENT TO TERMS

This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you") and:

Abraham Kevin Spann Brand LLC, doing business as Kevin Spann ("Company," "we," "us," or "our")

By accessing or using our website, software, or services, including any CRM, messaging, or communication tools powered by LeadConnector (GoHighLevel), you agree to be bound by this Agreement.

If you do not agree, you must not use our Services.

2. LICENSE GRANT

We grant you a limited, non-exclusive, non-transferable, revocable license to use our platform and any related tools solely for your personal or business use in connection with our services.

You may not:

  • copy or redistribute the software

  • sublicense or resell access

  • reverse engineer or attempt to extract source code

3. USE OF PLATFORM (LEADCONNECTOR)

Our Services may include access to tools powered by LeadConnector (GoHighLevel), including:

  • CRM system

  • messaging (SMS, email)

  • automation workflows

  • forms and funnels

You agree to use these tools:

  • only for lawful purposes

  • in compliance with all applicable laws

  • in accordance with messaging and privacy regulations

4. USER RESPONSIBILITIES

You agree that you will:

  • provide accurate information

  • maintain the security of your account

  • be responsible for all activity under your account

You are responsible for:

  • obtaining proper consent before contacting leads

  • complying with applicable laws (including TCPA, CAN-SPAM, and similar regulations)

5. PROHIBITED USE

You may not use the platform to:

  • send spam or unsolicited messages

  • engage in fraudulent or deceptive practices

  • distribute harmful or illegal content

  • violate any applicable law or regulation

Violation may result in suspension or termination.

6. DATA & PRIVACY

Your use of the platform is also governed by our Privacy Policy.

We may process data necessary to provide services, including:

  • contact information

  • communication data

  • usage data

You are responsible for ensuring you have proper rights to any data you input into the system.

7. THIRD-PARTY SERVICES

Our platform may integrate with third-party services, including:

  • LeadConnector (GoHighLevel)

  • communication providers

  • payment processors

We are not responsible for third-party services or their policies.

8. NO WARRANTY

The Services are provided "as is" and "as available."

We make no warranties regarding:

  • performance

  • availability

  • accuracy

We do not guarantee uninterrupted or error-free operation.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for:

  • indirect or consequential damages

  • loss of data, revenue, or business

  • damages resulting from your use of the Services

10. TERMINATION

We may suspend or terminate your access at any time if you:

  • violate this Agreement

  • misuse the platform

Upon termination, your right to use the Services ends immediately.

11. INTELLECTUAL PROPERTY

All content, software, and materials provided remain the property of the Company or its licensors.

You are granted no ownership rights under this Agreement.

12. APPLICABLE LAW

This Agreement shall be governed by the laws of the State of New York, without regard to conflict of law principles.

13. CHANGES TO THIS AGREEMENT

We may update this Agreement at any time.

Your continued use of the Services constitutes acceptance of the updated terms.
